Under some circumstances, the police could even charge you with a Notice to Appear and arrest you for the violation.<\/p>\n<p>This\u00a0mandate is in place due to\u00a0<a href=\"http:\/\/www.leg.state.fl.us\/statutes\/index.cfm?App_mode=Display_Statute&amp;URL=0300-0399\/0320\/Sections\/0320.02.html\" target=\"_blank\" rel=\"noopener\">Florida Statute 320.02<\/a>, which states that every person\u00a0who owns or is in charge of a motor vehicle driven or operated on the roads\u00a0<em>must<\/em>\u00a0register the vehicle in the state of Florida.<\/p>\n<p>This language can get a little tricky, but the definition of &#8220;motor vehicle&#8221; is anything that has wheels and a motor.\u00a0This can include a variety of different vehicles, including:<\/p>\n<ul>\n<li>Automobiles<\/li>\n<li>Motorcycles<\/li>\n<li>Trucks<\/li>\n<li>Trailers<\/li>\n<li>Semi-trucks and semi-trailers<\/li>\n<li>Recreational vehicles that have a separate motor power or are mounted on a vehicle<\/li>\n<\/ul>\n<p>While these charges are difficult enough, it&#8217;s also important to note that under the law, misdemeanor offenses cannot be sealed or expunged. This means that the charge will remain on your record for 10 years.\u00a0Most of the time, police only realize that a driver is operating an unregistered vehicle when they pull them over for another reason, such as:<\/p>\n<ul>\n<li>Speeding<\/li>\n<li>Driving\u00a0<a href=\"https:\/\/www2.rhinolawyers.com\/es\/know-your-rights-when-stopped-at-a-florida-dui-checkpoint\/\">under the influence<\/a>\u00a0(DUI)<\/li>\n<li>Reckless or distracted driving<\/li>\n<li>Running a red light<\/li>\n<li>Running a stop sign<\/li>\n<li>Making an unsafe lane change<\/li>\n<\/ul>\n<p>If they ask for your license and registration and you cannot provide the latter, they could give you not one but\u00a0<em>two\u00a0<\/em>traffic tickets.<\/p>\n<h3>Records Check<\/h3>\n<p>Even if a driver tries to explain the absence by saying the registration documents are at home. They will still get caught. Police officers perform a routine records check every time they pull someone over. This check allows them to see if there are any warrants out for the driver&#8217;s arrest or if the vehicle is stolen.<\/p>\n<p>The check will also alert them if the car is unregistered. Before issuing a charge, they will usually consider a few other factors. Including your level of cooperation and any prior arrests or open warrants you have faced.<\/p>\n<h3>Expired vs. No Registration<\/h3>\n<p>The driving penalties for operating an unregistered vehicle are different from those you could face if your vehicle\u00a0<em>is<\/em>\u00a0registered but the documents have expired.<\/p>\n<p>If the police catch you driving with an expired tag or registration, the most likely penalty\u00a0<a href=\"https:\/\/www2.rhinolawyers.com\/es\/i-received-a-traffic-ticket-how-can-i-avoid-the-points\/\">is a ticket<\/a>, especially if this is your first offense. In most cases, this offense will be considered a non-criminal, minor traffic violation. You may need to pay a fine, but it won&#8217;t usually be higher than $100.<\/p>\n<p>However, if you&#8217;re caught driving with an expired registration for the\u00a0<em>second<\/em> time or your registration expired more than six months ago, the penalty will escalate to a second-degree criminal misdemeanor charge. Florida Statute 320.07 states that if a vehicle&#8217;s tag has expired for more than six months, and this is your second or subsequent offense. You could face a criminal charge punishable by up to 60 days in jail.<\/p>\n<p>If you&#8217;re facing this charge or you&#8217;ve been caught driving a vehicle that isn&#8217;t registered at all, the offense will typically lead to a court date.
